Misconduct

Any allegation of misconduct or deviation from the Sentinel Scheme Rules should be made in writing to the Accreditation Body and should set out the details of the misconduct alleged. Once the written allegation is received the Accreditation Body of the Sentinel Scheme shall consult with the nominated representatives in Network Rail and reach an agreement on the actions to take into investigating any allegation as soon as possible.

Upon receiving a report of misconduct a Sponsor should request that the competence, individual (card) or company is suspended pending an investigation into the reported misconduct.

The subsequent investigation should then recommend lifting of the suspension or withdrawal of the competence/card/licence.

Lifting of a suspension shall only be considered when the individual or organisation have demonstrated competence, including the examples of misconduct for the purpose of these Sentinel Scheme Rules include: (non-exhaustive list)

1. Infringement of health and safety rules;
2. Negligence which causes or might cause unacceptable loss, damage or injury;
3. Theft, fraud and deliberate falsification of records;
4. Physical violence;
5. Deliberate damage to property;
6. Bringing the Sentinel Scheme into serious disrepute;
7. Bullying, harassment or discrimination;
8. Breach of confidence.

Withdrawal of Sentinel Competence Cards

1. Making a decision resulting in a major breach of safety;
2. Taking action that endangers the safety of self or others;
3. Individual demonstrates a history of poor safety behaviours;
4. The primary competence of PTS has expired on the card;
5. The medical details have expired on the card and there is no record on the Managers of the Sentinel Scheme database that a renewal has taken place;
6. The failure of a Drugs and Alcohol Screening;
7. The person is carrying out a role or task and the competency has expired and there is no record on the Managers of the Sentinel Scheme database that a renewal has taken place;
8. The individual is carrying out a role that they are not competent to perform.

The Managers of the Sentinel Scheme shall be informed of the removal of the competence card and shall then notify the Sponsor of the person concerned.
